Loading and Unloading Cargo Tank Motor Vehicles
Summary
The Department of Transportation (DOT), Pipeline Hazardous Materials Safety Administration, issued a notice of proposed rulemaking March 11, 2011 to require persons loading or unloading hazardous materials from cargo tank motor vehicles to do a risk assessment, develop operating procedures, and new training requirements.
Background
The proposal addresses safety concerns raised by the National Transportation Safety Board and the Chemical and Safety Hazard Investigation Board. It is intended to reduce the number of hazardous material incidents caused by human error and equipment failures. Comments are due in June.
TFI's Position
TFI and the Agricultural Retailers Association (ARA) will prepare joint comments that will support the intent of the rulemaking. However, we will ask for flexibility and credit for regulatory requirements already in place that cover training, risk assessment and operating procedures
