The Fertilizer Institute Applauds Senators’ Introduction of the FARM Act

The Fertilizer Institute (TFI) commends Senators Deb Fischer (R-Neb.) and Heidi Heitkamp (D-N.D.) for introducing bipartisan legislation that would require the Occupational Safety and Health Administration (OSHA) to withdraw a July 2015 memorandum that subjected approximately 3,800 agricultural retail facilities that store or handle anhydrous ammonia, a critical nitrogen fertilizer, to the Process Safety Management (PSM) program. This policy change was issued via memorandum and without proper public notice and comment.
In addition to requiring OSHA to withdraw the July 22, 2015 memo, The “Fertilizer Access and Responsible Management (FARM) Act” would require OSHA to follow the formal rulemaking process and allow impacted stakeholders, like agricultural retailers and their farmer customers, the opportunity to provide meaningful input.
“The Fertilizer Institute applauds Senators Fischer and Heitkamp for their bipartisan action that could potentially positively impact 3,800 agricultural retail facilities that store or handle anhydrous ammonia,” said Chris Jahn, TFI President. “It is important that we allow ag retailers and their farmer customers the opportunity to weigh in on regulations that directly impact their business.”
